Article 9 An application for the establishment of an international travel agency shall be submitted to the Department of Tourism Administration of the people's government of the province, autonomous region or municipality directly under the Central Government where it is located. After examination and approval by the Department of Tourism Administration of the people's government of the province, autonomous region or municipality directly under the Central Government, the application shall be submitted to the tourism administration department under the State Council for examination
An application for the establishment of a domestic travel agency shall be submitted to the administrative departments of the provinces, autonomous regions and municipalities directly under the Central Government where it is located for approval.
Article 10 When applying for the establishment of a travel agency, the following documents shall be submitted:
(1) Application for establishment;
(2) Feasibility study report on the establishment of travel agencies;
(3) Articles of Association of Travel Agencies;
(4) The curriculum vitae of the managers and deputy managers of travel agencies and the qualification certificates stipulated in Item 3 of Article 6 of these Regulations;
(5) Letters of credit for funds issued by the deposit-opening bank, capital verification reports issued by certified public accountants and their accounting firms or auditor firms;
(6) Certificate of business place;
(7) Certification of operating equipment.
Article 11 Upon receipt of the application, the tourism administrative department shall examine and verify the application according to the following principles:
(1) It conforms to the tourism development plan;
(2) To meet the needs of the tourism market;
(3) To meet the requirements specified in Article 6 of these Regulations.
The administrative department for tourism shall, within 30 days from the date of receipt of the application, make a decision on approval or disapproval and notify the applicant.
Article 12 The administrative department for tourism shall issue a Travel Agency Business License to the applicant who has been examined and approved, and the applicant shall obtain a Business License from the administrative department for Industry and commerce with the Travel Agency Business License.
Those who have not obtained the Business Operation License of Travel Agencies shall not engage in tourism business.
Article 13 If a travel agency changes its business scope, it shall go to the administrative department for Industry and Commerce for registration of the change after examination and approval by the administrative department for tourism which originally examined and approved it.
Where a travel agency changes its name, place of business, legal representative, etc., or stops or closes its business, it shall go to the administrative department for Industry and Commerce for the corresponding registration of change or cancellation, and shall file it with the administrative department for tourism and procession that originally examined and approved it for the record.
Article 14 The administrative department of tourism shall implement a system of announcement to travel agencies. Article 15 If a travel agency receives more than 100,000 tourists a year, it may establish a branch without legal personality (hereinafter referred to as a branch).
For each branch established by an international travel agency, the registered capital shall be increased by 750,000 yuan, and the quality guarantee deposit shall be increased by 300,000 yuan; for each branch established by a domestic travel agency, the registered capital shall be increased by 150,000 yuan and the quality guarantee deposit shall be increased by 50,000 yuan.
Travel agencies and their established branches shall carry out unified management, unified finance, unified solicitation and unified reception.
A branch established by a travel agency shall be subject to the supervision and management of the administrative department of Tourism under the local people's government at or above the county level.
Article 16 The establishment of permanent offices of foreign travel agencies within the territory of the People's Republic of China must be approved by the tourism administration department under the State Council.
Permanent offices of foreign travel agencies can only engage in tourism consultation, liaison and propaganda activities, and may not engage in tourism business.
